These Terms of Service ("Terms") govern your access to and use of the KodiSpace mobile application, website, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and able to enter into a legally binding contract under the laws of your country of residence. By using KodiSpace you represent that the information you provide is true, accurate, and complete.
2. Accounts
You are responsible for maintaining the confidentiality of your phone number, OTP codes, and any credentials used to access your account. Notify us immediately at hello@kodispace.com if you suspect unauthorised use.
3. Tenant Obligations
- Provide accurate identification and contact information.
- Use the Service only to search for and rent properties for lawful purposes.
- Honour any digital tenancy agreement you sign, including timely rent payments.
- Treat landlords and other users respectfully.
4. Landlord Obligations
- List only properties you have the legal right to rent out.
- Provide accurate descriptions, photos, pricing, and availability.
- Comply with all applicable housing, tax, and licensing laws.
- Respond to inquiries and respect tenant rights and privacy.
5. Digital Tenancy Agreements
KodiSpace provides tools to generate and electronically sign tenancy agreements. These agreements are legally binding contracts between the tenant and the landlord. KodiSpace is not a party to such agreements and does not provide legal advice. You are encouraged to seek independent counsel before signing.
6. Fees
Use of the Service is currently free for tenants. Landlords may be charged for premium listing features, verification, or transaction processing. All fees will be disclosed before you incur them. Fees are non-refundable except as required by law.
7. Payments
Where rent or deposits are processed through KodiSpace, payments are handled by licensed third-party providers. KodiSpace is not a bank and does not hold funds beyond what is necessary to facilitate transactions.
8. Prohibited Conduct
- Posting false, misleading, or fraudulent listings.
- Harassing, threatening, or discriminating against other users.
- Attempting to bypass, hack, or interfere with the Service.
- Using the Service for money laundering or any other illegal activity.
9. Intellectual Property
The KodiSpace name, logo, app design, and all related content are the exclusive property of KodiSpace and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. Content you submit (listing photos, descriptions) remains yours, but you grant KodiSpace a worldwide, non-exclusive licence to host and display it as part of the Service.
10. Disclaimers
The Service is provided "as is" and "as available". KodiSpace does not warrant the accuracy of listings, the conduct of users, or the outcome of any tenancy. You use the Service at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, KodiSpace and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the greater of (a) the fees you paid us in the 12 months before the claim, or (b) USD 100.
12. Termination
We may suspend or terminate your account at any time if you breach these Terms or use the Service in a way that harms KodiSpace or other users. You may delete your account at any time from the app settings.
13. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance.
